1. Use of Our Service

You agree to use GlucoPlot only for lawful purposes and in accordance with these terms. You are responsible for any content you provide or share through the Service, including any information you choose to enter.

2. Account and Data Storage Options

GlucoPlot offers different ways to use our Service:

• Mobile Apps — Local-First Storage: You can use our iOS and Android apps without creating an account. All data is stored locally on your device only and is not backed up to our servers. You are solely responsible for backing up your device. If you lose your device or uninstall the app, your data cannot be recovered. Note: When using AI-powered features (meal photo analysis, voice logging, text-based entry, receipt scanning), data is temporarily sent to our servers for processing via Google's Gemini AI, but results are stored locally on your device. We do not retain your images, audio, or text.

3. Wellness Information and Disclaimers

Wellness and Educational Purpose Only: GlucoPlot is a general wellness and nutrition tracking application designed for educational and informational purposes only. All content, including recipes, nutritional data, glucose tracking features, calorie calculations, and wellness insights, is provided solely for general wellness education and should not be considered medical advice, diagnosis, or treatment.

Nutritional Information Disclaimer: All nutritional information (including but not limited to carbohydrates, proteins, fats, calories, vitamins, and minerals) is based on USDA data and other public sources and should be considered rough estimates only. These values are not guaranteed to be accurate and can vary significantly based on factors such as preparation methods, brands used, and actual portion sizes. Calorie and macronutrient values are approximations derived from a combination of AI analysis, USDA public databases, and third-party nutritional data sources. For improved accuracy, users are encouraged to create private ingredients with custom nutritional data and build personal recipes.

AI-Generated Content: Our AI-powered meal analysis features provide estimates based on image and audio recognition. These estimates may be inaccurate and should not be relied upon for important decisions. Always verify nutritional information when accuracy is critical.

Nutrition Chat: The Nutrition Chat feature provides general nutrition information only based on today's logged data. It is not a substitute for professional advice. The AI assistant is not a qualified professional. Do not use Nutrition Chat for questions about medications, health conditions, supplements, or specialized dietary needs. Always consult a qualified professional for those questions.

AI Technology Disclosure: Our AI-powered features currently use Google's Gemini AI through secure proxy servers. Our AI provider may change at any time without notice. AI analysis is performed on a best-effort basis. The same meal photographed twice may produce different results. AI results should be treated as rough approximations and never as precise measurements.

AI Feature Availability: AI-powered features may be temporarily unavailable due to maintenance, cost management, or third-party service disruptions. Non-AI features remain fully functional during these periods.

Not a Medical Device: GlucoPlot is not a medical device. It has not been cleared, approved, or certified by the FDA, Health Canada, or any other regulatory authority. The application is not intended to diagnose, treat, cure, or prevent any condition.

Glucose Tracking Disclaimer: The glucose tracking features are designed for general wellness monitoring and pattern recognition only. Glucose readings and trends displayed in the app should never be used to make health decisions or replace professional monitoring. We do not provide medical, dosage, or treatment advice based on glucose data.

No Medical Advice: Glucoplate Inc., its employees, and affiliates are not medical professionals and do not provide medical or professional dietary advice. The personalized nutrition recommendations and glucose insights based on your metrics are general wellness guidelines only.

Consult Qualified Professionals: Always consult a qualified professional before making health-related decisions, especially if you have any conditions, are pregnant, breastfeeding, or have special dietary requirements. Never disregard professional advice or delay seeking care based on information provided by GlucoPlot.

Emergency Situations: GlucoPlot is not designed for emergency situations. If you are experiencing an emergency, call emergency services immediately.

4. Privacy

Your privacy is important to us. Please review our Privacy Policy to understand how we collect and use your data. Mobile apps store all data locally on your device for maximum privacy.

5. Subscription, Payments, and Refund Policy

Free Trial: Some subscriptions may include a free trial. The App Store or Google Play will show the price, any trial period, and the renewal terms before you confirm your purchase. If a trial is offered, you may cancel any time during it to avoid being charged.

Billing: GlucoPlot offers monthly and annual subscription plans. After any free trial ends, your subscription automatically renews and your payment method is charged the applicable fee at the start of each billing period (monthly or annual, depending on the plan you chose) until you cancel. Prices vary by region; the exact price is shown in the app before you subscribe.

Platform Billing: Subscriptions are purchased and processed through the Apple App Store or Google Play Store and are subject to their respective terms and refund policies. Billing, renewals, and cancellations are managed through your App Store or Google Play account.

No Refunds Policy: All subscription payments are final and non-refundable. We do not offer refunds or credits for any partial subscription periods, unused features, or any other reason. By subscribing, you acknowledge and agree to this no-refund policy.

Cancellation: You may cancel your subscription at any time through your account settings or through the App Store/Google Play. Upon cancellation, you will retain access to premium features until the end of your current billing period. After that, your access will be limited until you resubscribe. No partial refunds or prorated credits will be issued for the remaining days of your billing period.

6. Data Loss Disclaimer

Important: GlucoPlot is provided for informational and wellness tracking purposes only. While we strive to maintain reliable services, we cannot guarantee the permanent availability or preservation of your data under any circumstances.

Local Storage: When you use our mobile apps, you acknowledge that:

• Your data is stored solely on your device
• Glucoplate Inc. cannot access, recover, or restore your data
• You are solely responsible for backing up your device
• Data loss due to device failure, theft, loss, or app deletion is your responsibility
• We are not liable for any data loss

No Reliance on Data Preservation: You should not rely on GlucoPlot as your sole record of any critical information. We recommend backing up your device regularly and maintaining separate records of important information.

7. Limitation of Liability

General Limitation: To the fullest extent permitted by law, Glucoplate Inc. and its affiliates shall not be liable for any direct, indirect, incidental, consequential, or punitive damages arising out of your use of the Service.

Wellness-Related Limitations: We are not liable for any decisions or outcomes that may result from:

• Reliance on nutritional information, glucose tracking data, or calorie calculations provided by the Service
• Decisions made based on wellness insights, patterns, or recommendations displayed in the app
• AI-generated meal analysis or nutritional estimates
• Delayed or missed professional care due to reliance on app features
• Inaccurate data from connected devices or manual entries
• Technical failures, data loss, or service interruptions
• Any outcomes arising from dietary changes or lifestyle modifications inspired by app content

User Responsibility: You acknowledge that you use GlucoPlot at your own risk and that you are solely responsible for any decisions you make. You agree to consult appropriate qualified professionals before making any significant changes to your diet or wellness routine.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITH ALL FAULTS AND DEFECTS, WITHOUT WARRANTY OF ANY KIND. To the maximum extent permitted under applicable law, Glucoplate Inc. expressly disclaims all warranties, whether express, implied, statutory, or otherwise, including but not limited to implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, reliability, or completeness of any nutritional data, glucose readings, calorie calculations, AI-generated content, or other information provided through the Service. No advice or information, whether oral or written, obtained from the Company or through the Service shall create any warranty not expressly stated in these Terms.

9. Indemnification

You agree to indemnify, defend, and hold harmless Glucoplate Inc., its directors, officers, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or in any way connected with: (a) your use of the Service; (b) your reliance on any nutritional information, glucose data, calorie calculations, AI-generated content, or wellness insights provided by the Service; (c) any decisions or outcomes resulting from your use of the Service; (d) your violation of these Terms; or (e) your violation of any applicable law or regulation.

10. Assumption of Risk

You acknowledge and agree that the use of wellness and nutrition tracking technology involves inherent limitations and risks. By using the Service, you assume all risk associated with the accuracy and reliability of nutritional data, glucose tracking features, AI-generated analysis, and any other information provided by the Service. You agree that it is your sole responsibility to consult qualified professionals before making any wellness-related decisions.

11. Changes to Terms

We may update these Terms of Service from time to time. Continued use of the Service constitutes acceptance of the updated terms.

12. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the Province of Alberta and the federal laws of Canada applicable therein, without regard to conflict of law principles. Any dispute arising out of or in connection with these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of the Province of Alberta, Canada.

13. Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.
